TERMS AND DEFINITIONS
Broadband:
The term broadband commonly refers to high-speed internet access that is always on and faster than traditional access. The Federal Communications Commission has defined high-speed broadband as service that provides download speeds of at least 25 megabits per second (mbps) and upload speeds of at least 3 mpbs.
Fiber-optic broadband:
Fiber-optic broadband cable can run underground or in the air on existing poles. Pulses of light allow very reliable connections and can quickly carry large amounts of data over long distances. Fiber optic cable is a dedicated internet connection and is not shared with cable services. Fiber-optic network speeds are typically 100 megabits to 10 gigabits per second, compared to 20 to 100 megabits per second for a typical cable internet connection, or 3 megabits per second or less for traditional copper phone service.
Telecommunication Services:
Services that transmit information of the user's choosing to and from endpoints specified by the user without making any changes to the user's information. Services can include internet, phone and mobile communications.

What is SB-152?
Colorado Senate Bill 152 (SB-152) is a measure passed by the Colorado Legislature in 2005. The current law limits the ability of Colorado cities to provide or partner with private sector providers to provide a broad spectrum of telecommunication services (for example Broadband internet service), including:
- free Internet service in government buildings, parks and community centers;
- partnering with private businesses and leveraging government infrastructure to provide high-speed Internet service throughout the entire community; and
- direct provision of broadband services by municipal governments.
How would an exemption from SB-152 benefit Fountain?
An exemption (opt-out of SB-152) would allow Fountain City Council to have control over future decisions related to telecommunication service (including broadband internet).
What are the arguments against opting out of the restrictions of SB-152?
Research has indicated that most opposition related to these elections is largely driven by competition concerns from private providers.
If added to the November ballot, what does a “YES” vote do?
A “Yes” vote means you are voting to allow the City to “opt out” of SB 152. This would allow Fountain local control over future decisions related to broadband access in the community.
If added to the November ballot, what does a “NO” vote do?
A “No” vote would leave the existing SB 152 restrictions in place. This would leave any changes or improvements in telecommunication services (for example Broadband internet service) to current private sector providers.
Does opting out of SB 152 increase my taxes?
No, simply opting out of SB 152 will not increase your taxes.
Fountain residents voted to approve El Paso County’s SB-152 ballot measure in 2016. Does voter approval of El Paso County’s SB-152 ballot question effect the City of Fountain?
No. SB 152 requires voter approval by each individual jurisdiction.
Are other Colorado Entities exempt from SB-152?
In the past few years nearly 100 municipalities and 31 of the state’s 64 counties have approved SB-152 ballot initiatives in local elections. Citizens of El Paso County, Colorado Springs, and Manitou Springs, have passed ballot measures and opted out of SB-152.
What has Fountain done already?
Fountain contracted with HR Green in November 2017 to analyze the City’s current fiber optic assets and to develop a shared understanding between City Council and City Staff on issues related to broadband services.
What has Fountain spent already?
$25,850 for analysis and services provided by HR Green.
If added to the November ballot, what will Fountain do if the measure passes?
Fountain may explore options related to broadband accessibility in the electric service territory.
