2015 International Fire Code Section 307 – Burning Rules –FIRE PIT

 Section 104.1 of the 2015 International Fire Code authorizes the fire code official the authority to render interpretations of this code and to adopt policies, procedures, rules, and regulations in order to clarify the application of its provisions. The Fountain Fire Department interprets open burning that is not in an enclosed container to require a burn permit and comply with all of the provisions of Section 307 of the 2015 International Fire Code. The following is a summary of Section 307:

 Open fires require a permit

  • Fires in a commercially made outdoor fireplace are legal and do not require a permit.
  • Recreational fires are legal and do not require a burn permit. Recreational fires are fires conducted on private property and are enclosed in a fire pit permanently constructed of non-combustible material such as stone, brick, concrete, metal container, or fire ring with dimensions of the pit to be less than 3 ft in diameter and 2 ft in height. All materials burned in the fire pit must fit inside the dimensional confines of the fire pit and shall not be permitted to extend above or outside of the fire pit. Fire pits no longer are required to have a grated cover however; all materials burned shall fit inside as if it had a grated cover on.
  • Dry wood is the only material permitted to be burned with the exception of paper and cardboard use to kindle the fire.
  • Burning of trash, rubbish and yard debris (leaves, weeds & grass clippings) is prohibited.
  • Any time a fire is deemed unsafe by responding fire personnel it shall be immediately extinguished.


Recreational fires contained in an approved fire pit, outdoor fireplace, or barbeque grill are legal for use in the City Limits of Fountain.  The following recreational fire rules shall be adhered to:


  1. Approved containers shall be located not less than 10 feet from any structure.
  2. The area around the fire must be cleared of combustibles such as, grass, debris, etc...
  3. Must be attended at all times, up to the point of extinguishment, by a person 18 years of age or older, must not be impaired or under the influence of an intoxicating substance
  4. Must have resource to immediately contact the Fire Department (Regular or Mobile Telephone).
  5. A method of extinguishment shall be kept readily available during the use of these types of fires.
  6. Burning of trash, leaves, weeds or grass clippings in these containers is prohibited.
  7. It is permissible to burn wood tree limbs, twigs and manufactured fireplace logs that are cut to fit inside the fire pit or container.
  8. If the fire becomes uncontained or out of control, the Fire Department must be immediately contacted by calling 9-1-1
  9. The City of Fountain Fire Department reserves the right order extinguishment of the fire for any reason at any time.
  10. All fires must be extinguished by 12:00 Midnight. Recreational fires shall not be conducted prior to 8:00 AM.
  11. The City of Fountain Fire Department may inspect the fire at any time to ensure that the above conditions are being met.
