FIREWORK INFORMATION

FIREWORKS ORDINANCE:
 The City of Fountain City Council has approved Fireworks for 2016 with the following rules:
  • Use of Fireworks only approved from May 31 through July 6 this year
  • Legal fireworks are those sold in El Paso County Fireworks Booths (Class C)-no flying or exploding fireworks or firecrackers
  • You must be 16 years of age or older to purchase, transport or sell Class C fireworks in Fountain

Chief Anstine recommends these Guidelines: Know your fireworks; read the cautionary labels and performance descriptions before igniting; A responsible adult SHOULD supervise all firework activities. Never give fireworks to children; Alcohol and fireworks do not mix. Save your alcohol for after the show; Wear safety glasses when shooting fireworks; Light one firework at a time and then quickly move away; use fireworks OUTDOORS in a clear area-away from buildings and vehicles; Never relight a "dud" firework-wait 20 minutes and then soak it in a bucket of water; Always have a bucket of water and/or a charged water hose nearby; Never carry fireworks in your POCKET or shoot  them into METAL or GLASS containers; dispose of spent fireworks by wetting them down and place in a metal trash can away from any building or combustible materials until the next day.       

                                    

ORDINANCE NO. 1663

 

AN ORDINANCE AMENDING SECTION 070 (AMENDMENTS TO THE INTERNATIONAL FIRE CODE) OF CHAPTER 16 (FIRE CODE) OF TITLE 15 (FIRE) OF THE FOUNTAIN MUNICIPAL CODE TO AUTHORIZE THE POSSESSION, SALE, AND DISCHARGE CERTAIN FIREWORKS

 

WHEREAS, certain fireworks are allowed to be possessed, sold, and used within the unincorporated areas of the State of Colorado by Article 28 of Title 31 C.R.S. and within incorporated areas of the State of Colorado unless restricted by local law in those incorporated areas; and

 

WHEREAS, unincorporated areas where the sale and use of permissible fireworks adjoin the City limits and in some instances are partially or completely surrounded by the boundaries of the City; and

 

WHEREAS, the proximity and configuration of unincorporated areas outside the City limits where permissible fireworks are available for sale and use allows fireworks to easily be brought into and discharged within the City limits; and

 

WHEREAS, the existing prohibition of the use of fireworks within the City limits is difficult to enforce and many citizens desire the legalization of fireworks during the 4th of July holiday season; and

 

WHEREAS, in recognition of these enforcement difficulties and the desire of citizens to use fireworks, the City Council concludes the use of permissible fireworks within the City limits should be allowed during the 4th of July holiday season.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Fountain, Colorado:

 

            Section 1. SECTION 070 (Amendments to the International Fire Code) of Chapter 16 (Fire code) of Title 15 (Fire) of the Fountain Municipal Code is amended by adding a new Exception 4 to Section 5601.1.3 relating to Fireworks to read:
